What can I do if I was hurt in a Louisiana store?

People shop every day without giving too much thought to the process. Whether you are grocery shopping, picking out a gift for someone or finding something to wear, finding what you want for a reasonable price is perhaps all you are really thinking about.

However, that can change in the blink of an eye if you are injured in an accident inside the store. In many cases, you could be eligible for compensation from a premises liability claim. In order to determine this, you need to examine the situation more closely and really give it some thought so that you can answer a few questions about your slip, trip or falling accident.

  • Was your accident caused by a dangerous condition? This might include a puddle of water, poorly lit hallways, obstructed walkways or missing handrails in the stairwells.
  • Is it reasonable to believe that the storeowner caused, knew about or should have known about the dangerous condition? This could be the case if the condition occurred repeatedly, if it was in a high-traffic area or if others had notified the owner about the unsafe condition.
  • Was there a failure to clean up or warn you of the hazard? This could be indicated by a lack of signage, or evidence that the condition had been there for quite some time.
  • Did your accident happen because of that condition? For instance, did you slip on the puddle of water? Did you trip on torn-up carpet? Did you fall down stairs because it was so dark that you could not see?

If you answered yes to all these questions, you may very well have grounds to pursue a premises liability claim. Even if you answered maybe to some of them, you could still be in a position to receive compensation. You don't need to have all the answers right away, though you will need to get them as soon as possible.

This is why it is often a good idea to discuss this type of accident with an attorney immediately after a slip-and-fall or tripping accident in a store. Legal guidance can be crucial in assessing the situation, collecting evidence, building a claim and negotiating a settlement.
